General information


Personal data (hereinafter mostly referred to as “data”) is processed by us only to the extent necessary and for the purpose of providing a functional and user-friendly website, including its content and the services offered there. According to Article 4(1) of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to only as “GDPR”), “processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. In the following privacy policy, we inform you in particular about the type, scope, purpose, duration and legal basis of the processing of personal data, insofar as we decide either alone or jointly with others on the purposes and means of processing. The policy also provides information about the third-party components we use for optimization purposes and to increase the quality of use, insofar as third parties process data under their own responsibility. II. Rights of users and data subjects


With regard to the data processing described in more detail below, users and data subjects have the right

  • to confirmation as to whether data concerning them is being processed, to information about the processed data, to further information about the data processing and to copies of the data (see also Art. 15 GDPR);

  • to rectification or completion of incorrect or incomplete data (see also Art. 16 GDPR);

  • to the immediate erasure of the data relating to them (see also Art. 17 GDPR) or, alternatively, if further processing is required in accordance with Art. 17 (3) GDPR, to the restriction of processing in accordance with Art. 18 GDPR;

  • to receive the data relating to them and provided by them and to transfer this data to other providers/controllers (see also Art. 20 GDPR);

  • •to lodge a complaint with the supervisory authority if they are of the opinion that the data relating to them is being processed by the provider in breach of data protection regulations (see also Art. 77 GDPR). This can be done through the North Rhine-Westphalia State Commissioner for Data Protection, Kavalleriestraße 2 - 4, 40213 Düsseldorf, Germany.


In addition, the provider is obliged to inform all recipients to whom it has disclosed data of any rectification or erasure of data or restriction of processing carried out on the basis of Articles 16, 17 (1), and 18 GDPR. However, this obligation does not apply if such notification proves impossible or involves disproportionate effort. Notwithstanding this, the user has a right to information about these recipients. In accordance with Art. 21 GDPR, users and data subjects also have the right to object to the future processing of data relating to them, provided that the data is processed by the provider in accordance with Art. 6 (1) f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permitted.

III. Information on data processing


The data relating to you that is processed when you use our website will be erased or blocked as soon as the purpose of storage no longer applies, if the erasure of the data does not conflict with any statutory retention obligations and where no other information on individual processing methods is provided below.

Contact inquiries / contact methods


If you contact us via contact form or email, the data you provide will be used to process your inquiry. The provision of this data is necessary for processing and responding to your inquiry – without it, we cannot respond to your inquiry or can only do so to a limited extent. The legal basis for this processing is Art. 6 (1) b) GDPR. Your data will be erased once your issue has been conclusively resolved, provided that the erasure of such does not conflict with any statutory retention obligations, as in case of any subsequent contract processing, for example.

Licenses / contract processing


If you purchase a license via our website, we will collect and store the data you enter when applying (e.g. your name, address, email address and API data) solely for pre-contractual services, for the performance of the contract or for the purpose of customer care (e.g. to provide you with an overview of your previous orders and OKX trading activities with us or to be able to generate your monthly invoices). We can only conclude and process a contract if you provide your data. At the same time, we store the IP address and the date and time of your registration. This data will, of course, not be shared with third parties. As part of the further registration process, we will obtain your consent to this processing and refer you to this privacy policy. The data collected by us will be used exclusively for the provision and billing of our services. If you consent to this processing, Art. 6 (1) a) and b) GDPR form the legal basis for the processing.


You can revoke the consent granted to us for the acquisition of a license and for the use of your data for contract processing at any time with effect for the future in accordance with Art. 7 (3) GDPR. All you have to do is inform us of your revocation. The data collected in this context will be erased once the contract has been performed in full and processing is no longer required. However, we are obliged to observe retention periods under tax and commercial law.

Stripe


Payments to us are processed via the payment service provider Stripe, â„… Legal Process, 510 Townsend St., San Francisco, CA 94103 (Stripe). This constitutes our legitimate interest in offering an efficient and secure payment method (Art. 6 (1) f) GDPR). In this context, we share the following data with Stripe to the extent necessary to perform the contract (Art. 6 (1) b) GDPR). Name of the cardholder, email address, customer number, order number, bank details, credit card details, credit card expiry date, card validation code (CVC), date and time of the transaction, transaction amount, name of the provider, and location. The processing of the data specified in this section is not required by law or contract. We cannot process a payment via Stripe without your personal data.


For data processing activities, Stripe assumes a dual role as controller and processor. As the controller, Stripe uses your submitted data to meet regulatory obligations. This constitutes Stripe’s legitimate interest (Art. 6 (1) f) GDPR) and serves to perform the contract (Art. 6 (1) b) GDPR). We have no influence on this process. Stripe acts as a processor in order to complete transactions within the payment networks. Within the scope of the order processing relationship, Stripe acts solely in accordance with our instructions and has been contractually obliged to comply with the data protection regulations within the meaning of Art. 28 GDPR.


Stripe has implemented compliance measures for international data transfers. These apply to all global activities where Stripe processes personal data of natural persons in the EU. These measures are based on the EU standard contractual clauses (SCCs). You can find further information on objection or opt-out options against Stripe at: https://stripe.com/legal/privacy-center. Your data will be stored by us until payment has been processed in full and in accordance with the statutory retention periods pursuant to Section 147 AO [German Tax Code] / Section 257 HGB [German Commercial Code]. This also includes the time required to process refunds, receivables management and fraud prevention.
